These Terms & Conditions govern your use of 5thcourt.com and purchases from 5th Court, operated by FASHION BOUTIQUE LLC (“5th Court,” “we,” “us” or “our”). By using the site or placing an order, you agree to these terms. Nothing in these terms limits rights that cannot be waived under applicable law.

2. Eligibility and accounts

You must be able to form a legally binding agreement to place an order. You are responsible for accurate account information, safeguarding your password and activity under your account. Tell us promptly if you suspect unauthorized use.

3. Products and availability

We make reasonable efforts to present product descriptions, images, colors, prices and availability accurately. Screen settings can affect color, and measurements may be approximate. Products and quantities may change without notice. We may correct errors, update information or cancel an affected order; if payment has been collected for a canceled item, we will issue an appropriate refund.

4. Orders and acceptance

Your order is an offer to buy. An order confirmation acknowledges receipt but does not necessarily mean the order has been accepted. Acceptance occurs when payment is authorized and we confirm or ship the order. We may decline or cancel an order for legitimate reasons including unavailable stock, pricing errors, suspected fraud, payment issues, shipping restrictions or purchase-limit violations.

5. Prices and payment

Prices are shown in U.S. dollars unless stated otherwise. Shipping charges and any applicable taxes are displayed before you place the order. Payment must be made using a method offered at checkout. A bank or provider may place a temporary authorization on your account.

6. Promotions

Promotions, discount codes and gifts are subject to their stated dates, eligibility and exclusions. Unless expressly allowed, offers cannot be combined, exchanged for cash or applied to previous purchases. We may withdraw or correct a promotion affected by an error or misuse.

7. Shipping and delivery

We currently ship to eligible addresses in the United States. Delivery estimates are not guarantees and can be affected by processing volume, holidays, weather, carrier delays or address problems. You are responsible for providing a complete, accurate delivery address. Title and risk pass as provided by applicable law and the selected delivery arrangement.

8. Returns and refunds

Eligible items may be returned within 30 days of delivery under our Returns & Exchanges Policy, which forms part of these terms. Returned items must meet the stated conditions. Approved refunds are issued to the original payment method. Any nonwaivable legal rights remain unaffected.

9. Damaged, defective or incorrect items

Contact us promptly with your order number, details and photos. We will review the issue and provide an appropriate remedy consistent with the circumstances and applicable law.

10. Site use

You may use the site only for lawful, personal shopping and information. You may not interfere with security or operation, introduce malicious code, scrape or copy content at scale, impersonate another person, misuse promotions, attempt unauthorized access, or use the site to violate another person’s rights.

11. Intellectual property

The site and its original text, design, graphics, logos, software and arrangement are owned by or licensed to 5th Court and protected by applicable intellectual-property laws. Brand names and trademarks belong to their respective owners. No rights are granted except the limited right to use the site for its intended purpose.

12. Third-party services and links

The site may use or link to third-party payment, shipping, analytics or social services. Those services may have their own terms and privacy practices. We are not responsible for third-party sites or services outside our control, although this does not limit responsibility that cannot lawfully be excluded.

13. Disclaimers and limitation of liability

To the fullest extent permitted by law, the site is provided on an “as available” basis. We do not guarantee uninterrupted or error-free access. We are not liable for indirect, incidental, special or consequential losses arising from use of the site or products where such exclusion is lawful. Our aggregate liability for a claim relating to an order will not exceed the amount paid for that order, except where a different limit is required by law. We do not exclude liability that cannot legally be excluded.

14. Governing law and disputes

These terms are governed by the laws of the State of Idaho and applicable United States federal law, without regard to conflict-of-law rules. Any dispute may be brought in a court with lawful jurisdiction. Mandatory consumer protections in your state continue to apply.

15. Changes and severability

We may update these terms for future use of the site. The version in effect when your order is accepted governs that order. If any provision is found unenforceable, the remaining provisions remain in effect.
